STUDIO UP TERMS OF USE
1. PURPOSE AND VALUES
We strive to provide the highest level of comfort, technical expertise and safety in Pole & Aerials practice to all our Members in an inclusive way, regardless of their experience, technical level or physical development.
We support and recognize all Pole and Aerials categories, styles and technical levels, as well as each Member´s personal goals and vision throughout their practice.
All Studio UP Members shall respect and honour our Purpose and Values mentioned above.
2. GENERAL PROVISIONS
Member: any person duly registered at Studio UP with an active monthly subscription or a pack of 5 or more classes within the period of validity.
These Terms of Use regulate the Members access to the facilities of “Clube de Praticantes de Pole Sport Studio UP Porto”, located at Rua Moreira 251, Porto, with the NIPC 902179993 (Studio UP), and the corresponding use of the facilities and equipment for the practice of physical and sports activities, as well as the provision of services related to the forementioned activities.
The use of the facilities, equipment and materials by the members must be done in accordance with the Terms of Use and the regulations displayed at the facilities. It is of the Members´ responsibility to consult those documents regularly in order to be informed of any possible changes.
The operating hours of the facilities are displayed on the entrance to the premises and may suffer changes at any time. In case of any changes, Studio UP shall publish the new schedule in advance on the usual virtual/physical notice boards and at www.studioupporto.com.
Due to the constant changes in the sports activities market, Studio UP may, at any time, add or change the types of services, equipment and activities provided at its facilities, safeguarding the best interests of the Members or due to changes in its policy, which the Members acknowledge and accept. As a basic rule, we shall discontinue classes that have an average of less than 4 attending students (including online), during the period of 3 months.
Studio UP reserves the right to change its price list at any time, based on any changes in its policy, increase in activities costs, economic, social and/or political changes in the society, as well as legislative changes, with prior notice of minimum 30 days, which the Members acknowledge and accept.
Benefits, promotions and discounts are subject to confirmation of their availability and the legitimacy for obtaining them. Studio UP reserves the right to cancel and/or change benefits, promotions, and discounts at any time due to its policy, which the Members acknowledge and accept.
3. USE OF THE FACILITIES
Participation in activities is guaranteed only for the Members that have registered in the electronic reservation system studioup.isportsystem.com, have signed the Terms of Use and made a prior reservation. It is possible to attend the class without a reservation, subject to availability of a vacancy. If a class has no registered students 1 hour prior to its starting time (in-person or online), the instructor has the right not to come to the facilities.
If the Members are not able to attend the class, it is obligatory for them to cancel their reservation in the booking system as soon as possible. Cancellations shall be done not later than 3 hours in advance, or 12 hours in case of classes starting at 11.30 AM or earlier. Non-attendance to the booked class, or cancelling after the limit period does not entitle the Members to any type of refund. Non-attendance to the booked class (in studio or online), or late cancellation (in studio) for 5 times will result in the Member suspension in the booking system for 30 days and elimination of all his/her future bookings. However the Members can attend classes without booking, being subject to the availability of vacancies. The number of faults is set to zero every 6 months. In case of unforeseen circumstances/emergencies call 915 01 22 66, and we will cancel your booking without any penalty.
The facilities will be closed on national, municipal or optional holidays, which shall not entitle the Members to any deduction in the usage fees or other compensation. However, Studio UP exceptionally holds regular activities on holidays whenever possible, according to the instructors´ availability.
In the case of limited use of the facilities, either partial or total, for occasional activities (such as construction, maintenance, competitions, seminars, cultural or sports events, among others), Studio UP shall to notify all its Members in advance by e-mail, without conferring the right to any deduction in usage fees or compensation. However, whenever possible, Studio UP will provide another place and/or schedule for its services. In case of closure periods of 30 consecutive days or more, the amount paid by the Member for that period shall be credited to the Member's account.
The Members´ entry to the facilities and their access to the activities may be suspended in the case of exceeding the capacity or force majeure circumstances.
Studio UP is not responsible for any loss, damage, misplacement or theft of objects inside the facilities, nor for any personal accidents resulting from imprudence or misuse of the premises and equipment. In the case of damage caused by the Members/users to the facilities and materials due to improper or unauthorized use, it shall be immediately paid for at the facilities by their originator(s), the same applying to the loss of materials.
Unlimited fees allow the total use of the facilities, equipment, and services available during activity hours, with a limitation of 2 hours per day, and the attendance of group classes, when applicable, being subject to availability. However, if there are vacancies available, the Member is allowed to participate in classes beyond this limit, by attending the class without a reservation and requesting the instructor to enroll him/her in the respective class.
4. RIGHTS AND DUTIES
At the time of registration, the Members must provide their personal data with complete information, and shall update them immediately with our customer services in the case of any changes. The Member's personal data shall be processed by Studio UP in accordance with the applicable legislation.
It is the Member's obligation to pay fees on time, in accordance with the current price policy and the chosen fee, regardless of the actual use of Studio UP's facilities, equipment and/or services.
Under the terms and for the purposes of the provisions of the Act #5/2007 from January 16th, the Members are obliged to declare that they do not suffer or reveal any counter indications to the practice of the physical activity they intend to carry out, assuming the whole responsibility for the failure to comply with this duty.
The members present in-person within the Studio UP premises, and during the practice, are covered by the Personal Accidents insurance provided by Generali Seguros S.A., not being covered for the conditions caused in the long term, even if during the practice, or previously existing. Only coverage for the damages resulting directly from the accident is guaranteed. Insurance Coverage: death or permanent disability €28,500, treatment expenses €4,600 (deductible €75), funeral expenses €2,500. The Members who take the online classes are excluded from this coverage, their practice being at their own risk or covered by an insurance policy duly contracted and paid by themselves.
In the case of an accident, the Member shall report it to Studio UP as quickly as possible, in order to fill out the form intended for these purposes and for Studio UP to be able to send the documents to the insurance company no later than 48 hours after the accident. The Member shall attend any hospital emergency room, request an emergency medical report and present to Studio UP the proof of expenses incurred during the process. Refund cases are decided by Generali Seguros S.A., and never by Studio UP.
The Member shall, at all times, be aware of the provisions of the latest version of the Terms of Use and comply with them, as well as with the other rules displayed at the premises and also available at www.studioupporto.com.
The Member shall behave politely towards the Studio UP employees and other Members.
The Members are prohibited to use Studio UP's facilities and/or equipment for their own profit, unless previously authorized by Studio UP.
Medical leave: Allows the Member, for a maximum period of 90 days, to keep his/her vacancy when not attending classes, by presenting a medical certificate as a proof of incapacity, within the first 5 days of its issue. During this period the Member shall not pay the fees, and can return to the activities without paying the re-registration fee. In the case of a semi-annual or annual payment, the latter shall be paused for the time indicated by the medical professional, and for a maximum period of 90 days.
5. RULES
During the practice of the activities, the following is not allowed: chewing gum, consuming alcoholic beverages, eating, smoking, using creams, oils or any other product that may damage the equipment or interfere with its quality or performance; it is forbidden to use objects that may damage the surface of the equipment and affect third parties, namely the use of rings, bracelets, watches, earrings, clothing/accessories with metal or plastic pieces, etc. (zippers, hooks, decorations, etc.).
The entry of animals to the premises is prohibited, except for guide dogs.
Taking photographs and recording video on the premises is allowed and welcomed. However, and regardless of the purpose of recording, in the case when other people might be captured in the photo/video, or may consider they are positioned in the scope of your camera, their prior expressed authorization is required, or they must be assured that they are not appearing in the scope of your camera in any way. The same rule applies to the media publishing of the materials. The recording must not, in any circumstances, interrupt with the usual practice of other members and/or with the Instructor´s work, being the latter authorized to decide at his/her own discretion to allow recording only at the certain moments of the class, for the comfort and efficiency of practice of all the participants in the group.
Members are not allowed to participate in activities without the presence of a responsible staff member. During the class, the presence of individuals who are not participating in the class, whether Members or not, is not allowed in the practice room. Non-participating individuals are not allowed to observe the class, even if they have previously booked it. Family members and friends are welcome in the designated area, such as the sofa, entrance, or, with the instructor's permission, in the office.
The changing room is the designated area for clothes changing. Only Studio UP staff may use the office for changing, as well as exceptionally men, in the absence of another location.
6. PAYMENTS
Registration for the subscription fees implies the payment of the amount established in the price list. In the case the Members stop attending Studio UP activities without paying the due fee, or for a period more than 1 year, they shall pay a new registration fee upon resuming the activities, equal to the registration fee set in the price list at the moment of their return, and the prices valid at the time of their re-registration will be applied. In the case of monthly subscription by direct debit, the Members maintain their base rate for the entire duration of their stay at Studio UP and do not pay any renewal fees (except in the event of a general increase in all fees). However, if the Member stops attending Studio UP activities for a period of 6 months or longer, upon resuming the activities, the prices valid at the time of their re-registration will be applied.
Payments of monthly fees by subscription are made on the 2nd of each month, with an option of the 9th; when opting for the 9th, the Members must inform Studio UP about that change of the date. If the payment date falls on a holiday, Saturday or Sunday, the payment will be charged on the next business day. For the direct debit payments, members must fill out the necessary information in the online Membership Form.
If a direct debit payment is rejected by the Member's bank, he/she will receive a notification by e-mail to settle the outstanding amount. Failure to pay the monthly fee after this notice results in the cancellation of the membership, which shall be done on the 15th of each month. Resuming will only be possible if there are vacancies available in the chosen schedule, with the payment of a re-registration fee and settlement of the outstanding amount.
Other payments (drop-in classes, packages, 31-day unlimited) can be made in cash at the Studio UP premises during class hours, through the iSport booking system (via PayPal or credit/debit card), by bank transfer or MBWay. For cash, transfer or MBWay payments, it is mandatory to send a proof of payment to Studio UP, indicating the Member's name. Otherwise, Studio UP is not responsible for activating the credits for paid classes.
7. MODIFICATIONS, SUSPENSION AND CANCELLATION
Changes in class frequency and requests for suspension/cancellation of subscriptions with the payment by direct debit must be made at least 15 days before the start of each month. Requests made after this date shall be processed for the following month.
Cancellations/suspensions of monthly fees apply only for full months. Upon resuming the activity, a full monthly fee shall always apply. Partial monthly fee is possible exclusively at the time of registration or re-registration with the payment of a registration fee.
Membership fees, registration fees, renewal fees, or paid class packages are non-refundable in the case of cessation of activity by the Member or upon expiration of the validity period indicated in the price list at the moment of purchase. However, they can be transferred to another person corresponding to the following criteria: 1) not an active member of Studio UP at the moment of transfer; 2) no outstanding payments to Studio UP.
8. FINAL PROVISIONS
Conflict management: The Members may resort to the Porto Consumer Information and Arbitration Center whenever they need support in resolving conflicts between the Members and Studio UP; more information at www.cicap.pt.
Failure to comply with these Terms of Use, as well as any actions against the policies established in them, give the right to Studio UP to refuse, without prejudice to special legislation provisions, access or presence of the Members at its facilities. Aspects not mentioned in these Terms of Use shall be resolved by Studio UP.
These Terms of Use, as well as the current price list and other information, such as contacts, shall be available at www.studioupporto.com and may be amended or modified by Studio UP whenever it deems appropriate, becoming effective on the day following its approval.
